Counter-Notification Procedure

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your contact information including your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or if outside the United States, to any jurisdiction where Free DP Images may be found), and that you will accept service of process from the person who provided the original complaint

Legal Warning

Knowingly making material misrepresentations in a counter-notification may result in liability for damages, including costs and attorney's fees. We forward counter-notifications to the original complainant.

What happens after I submit a DMCA notice?

We review your notice within 24 hours. If complete and valid, we remove the infringing content immediately and notify the user who uploaded it. We also keep a record of the notice for our repeat infringer policy. You will receive confirmation of the takedown action.

Can I submit a DMCA notice for multiple infringements?

Yes, you can include multiple infringing works in a single notice if they are owned by the same copyright holder. Please provide clear identification and location information for each infringing item. For large-scale infringement, please contact us directly to discuss bulk processing options.

What if I'm not the copyright owner but represent them?

Authorized agents can submit DMCA notices on behalf of copyright owners. You must include proof of authorization or state that you are authorized to act on the copyright owner's behalf. This can be in the form of a signed authorization letter or documentation showing agency relationship.

How long does the counter-notification process take?

After receiving a valid counter-notification, we forward it to the original complainant. If they don't file a court action within 10-14 business days, we may restore the removed content. The entire process typically takes 2-3 weeks from receipt of counter-notification.

What if my content was removed by mistake?
